Terms of Service

1. Who we are

GeoFavs is operated by {{COMPANY_LEGAL_NAME}}, registered in Spain, with registered address at {{COMPANY_REGISTERED_ADDRESS}} ("GeoFavs", "we", "us", "our").

These Terms of Service ("Terms") govern your access to and use of the GeoFavs mobile application and related services. By creating an account or using GeoFavs, you agree to these Terms.

2. What GeoFavs is

GeoFavs is a place discovery app built on physically verified recommendations. To recommend a place, you must be within 30 metres of it at the time of the recommendation. This physical verification is what makes GeoFavs recommendations trustworthy and distinct from other review platforms.

GeoFavs also shows you social signals: which places people you follow or share affinity with have recommended, and which places are popular among people of your generation or gender and generation.

3. Eligibility

You must be at least 16 years old to use GeoFavs. By creating an account you confirm you meet this requirement. If you are between 16 and 18, you confirm you have obtained any parental or guardian consent required in your jurisdiction.

GeoFavs is not directed at children under 16. If we become aware that a user is under 16, we will delete their account.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate information when registering or updating your profile.
• Choose a username that does not impersonate another person or entity.
• Not share your account with others.
• Notify us immediately at hello@geofavs.com if you suspect unauthorised access to your account.

5. Public waitlist

The GeoFavs website may offer a public waitlist by city and neighbourhood. Joining the waitlist does not guarantee access on a specific date, access in a particular store, or availability in your area. Neighbourhood ranking is used as a demand signal to prioritise rollout.

Referral links may move a waitlist position forward when enough valid invited people join. We may reject, reverse or limit referral boosts that appear abusive, automated, fraudulent or inconsistent with these Terms.

6. Recommendations and physical verification

A recommendation in GeoFavs is a verified signal that you have personally visited a place. To create or remove a positive or negative recommendation, you must be within 30 metres of the place at the time of the action. This distance is validated server-side.

Once a recommendation is created, you may not remove it for 14 days. This cooldown applies to both positive recommendations (❤️) and negative ones (👎), and is designed to preserve the integrity of the signal.

You may save a place (bookmark) from any distance. Saving is not a recommendation and does not appear as a social signal to other users.

7. Content you contribute

You may upload a profile photo and add links to your Instagram and TikTok profiles. By submitting any content to GeoFavs, you grant us a worldwide, royalty-free, non-exclusive licence to display, store and moderate that content as part of the GeoFavs service.

You are solely responsible for your content. You agree not to upload content that:

• Is false, misleading or intended to deceive other users.
• Violates the rights of any third party, including intellectual property or privacy rights.
• Is unlawful, offensive, harmful or sexually explicit.
• Contains viruses, malware or any code intended to disrupt the service.

We reserve the right to remove content that violates these rules at any time, without prior notice.

8. Social features

GeoFavs allows you to follow other users and be followed. If your account is set to private, other users must send a follow request that you approve before they can see your recommendations. If your account is public, your recommendations are visible to all GeoFavs users.

You may change your account privacy setting at any time from your profile settings. Making your account private does not retroactively hide your recommendations from users who already follow you.

9. AI review analysis

GeoFavs offers an optional AI-powered analysis of a place's Google reviews. This feature sends review data to an AI provider (Anthropic) for processing and returns a summary to you. The analysis is provided as an informational tool only and does not constitute a guarantee of quality, safety or accuracy. GeoFavs is not responsible for the content of AI-generated summaries.

AI analysis is subject to a monthly usage limit per user. The limit and availability of this feature may change.

10. Location data

GeoFavs requires access to your device location to show nearby places and to verify that you are physically present at a location when creating a recommendation. Location access is requested at the system level and can be revoked at any time from your device settings, though this will prevent certain features from working.

We do not track your location continuously. Location is used in the foreground while you are actively using the app and only with your permission.

11. Acceptable use

You agree not to:

• Create fake or inaccurate recommendations (e.g. recommending a place you have not visited).
• Use automation, bots or scripts to interact with GeoFavs.
• Attempt to manipulate the affinity or social ranking systems.
• Harass, impersonate or harm other users.
• Attempt to reverse-engineer, scrape or circumvent any security measure of the service.
• Use GeoFavs in any way that violates applicable law.

Violations may result in suspension or permanent removal of your account.

12. Intellectual property

GeoFavs and its content, features and functionality are owned by {{COMPANY_LEGAL_NAME}} and are protected by intellectual property law. You may not copy, modify, distribute or create derivative works based on GeoFavs without our prior written consent.

13. Third-party services

GeoFavs uses Google Places to provide place data and maps. Place information is sourced from Google and may not always be accurate or up to date. GeoFavs is not responsible for the accuracy of third-party place data.

Links to external profiles (Instagram, TikTok, Google Maps) are provided as a convenience. GeoFavs is not responsible for the content or practices of external websites.

14. Disclaimer and limitation of liability

GeoFavs is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free or free of harmful components. Place recommendations reflect the personal experience of individual users and do not constitute professional advice.

To the maximum extent permitted by applicable law, GeoFavs' liability for any claim arising from your use of the service shall not exceed the amount you paid to GeoFavs in the 12 months preceding the claim (which may be zero, as the consumer app is currently free). GeoFavs is not liable for indirect, incidental or consequential damages.

15. Account deletion

You may delete your account at any time from your profile settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Anonymised or aggregated data derived from your recommendations may be retained so place-level counts and rankings remain coherent after your profile is gone.

16. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you via the app or by email at least 14 days before the new Terms take effect. Continued use of GeoFavs after that date constitutes acceptance of the updated Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Any disputes shall be submitted to the courts of Spain, without prejudice to mandatory consumer protection provisions applicable in your country of residence.
